Terms of Service

What we do

Kismet is a marketplace that lets you discover and book restaurants, bars, venues, classes and experiences run by independent businesses (“venues”). We are not the venue. The venue is responsible for the service you receive, including food, safety, accessibility and anything that happens on its premises.

Your account

• You must be at least 18 years old to create an account.
• Give accurate details and keep your password safe. You are responsible for activity on your account.
• You can delete your account at any time from your profile. See the Privacy Policy for what happens to your data.

Bookings, holds and payments

• When you choose a time we hold it for you for a short period (usually 10 minutes) while you check out. If you don't finish, the hold is released.
• A booking is confirmed only when you see the confirmation screen or receive a confirmation message.
• Some venues require a deposit or full prepayment. Prices, deposits and fees are shown before you pay. Payments are processed by our payment partners (Stripe and/or PayMongo) under their own terms.
• Each venue sets its own cancellation policy, shown before you book. Cancelling inside the policy window, or not showing up, may mean you lose some or all of your deposit.
• If a venue cancels, or a payment arrives after the slot was taken, you get a full refund.
• Please arrive on time. Venues may release your table or spot if you're late, according to their policy.

Decide for Me

Decide for Me picks a venue for you from places that match your filters and are available. Random modes give every eligible option an equal chance, decided on our servers. Smart Pick ranks options using the factors we explain in the app. Sponsored or featured placement never influences any game. A pick is a suggestion: you're free to play again or book something else, and we can't guarantee you'll love every pick.

Kismet Dates

• Kismet Dates is for verified adults (18+). You must pass an ID and selfie check, use real photos of yourself, and keep only one profile.
• There is no chat: when two people like each other, we suggest a date at a venue. Both must accept; then a deposit is paid by one person or split, as shown on your profiles before you swiped.
• The deposit is applied to your bill at the venue. If you cancel a confirmed date at least 24 hours ahead, deposits are refunded. If you cancel later, or don't check in at the venue, your deposit is given to your match as Kismet credit (less our fee) and it counts as a missed date. Two missed dates pause your profile.
• Be respectful. Harassment, asking for money, hiding who you are or making someone feel unsafe will get you removed. Block or report anyone from the app; reports are reviewed by our team.
• We verify identities but can't guarantee anyone's conduct. Meet only at the venue we book, tell a friend (use the share link), and call 911 in an emergency.

Reviews and content

• You can review a venue after a completed visit. Reviews must be honest, based on your own experience, and must not contain hate speech, harassment, personal data about others or illegal content.
• You keep ownership of what you post, but you give Kismet a worldwide, royalty-free licence to display, reproduce and adapt it to operate and promote the service.
• We may remove content or suspend accounts that break these terms.

Things you must not do

• Make bookings you don't intend to keep, resell bookings, or use bots or scripts to grab availability.
• Interfere with the service, probe it for vulnerabilities without permission, or access other people's accounts or data.
• Use the service for anything illegal, fraudulent or harmful.

Venues

Businesses that list on Kismet agree to keep their details, availability, prices and policies accurate, to honour confirmed bookings, and to pay any agreed commission or fees. Additional terms may apply to venues and are provided during onboarding.

Liability

We work hard to keep the service accurate and available, but we provide it “as is” and can't guarantee it will be uninterrupted or error-free. To the extent the law allows, we are not liable for indirect or consequential losses, or for the acts or omissions of venues, and our total liability to you for any claim is limited to the amount you paid through Kismet for the booking concerned. Nothing in these terms limits rights you have under the Consumer Act of the Philippines or other laws that can't be excluded.

Changes and termination

We may change these terms or the service. If changes are significant we will tell you before they take effect; continuing to use Kismet means you accept them. You can stop using the service and delete your account at any time. We may suspend or close accounts that break these terms.

Governing law

These terms are governed by the laws of the Republic of the Philippines. Disputes will be handled by the competent courts of [city], Philippines, unless the law gives you the right to bring a claim elsewhere.
